Water & Drain USA provides and coordinates water cleanup, drain cleaning, cleaning, and related property services. Services may be performed by independent service providers and subcontractors selected according to the service requested and the location.

Service availability varies by location. When a project requires a particular professional license, certification, permit, or regulated trade service beyond the applicable cleanup or cleaning scope, appropriately licensed or qualified service providers are utilized as required by applicable federal, state, and local requirements. When a drain problem requires plumbing alteration, pipe replacement, installation, or another regulated trade service beyond drain cleaning, appropriately licensed or qualified service providers are utilized where required by applicable law.

Water & Drain USA does not represent itself as holding a particular professional or trade license in a jurisdiction unless expressly stated.

Submitting a request through the Site, by phone or by email does not guarantee that service is available or that a service professional will be dispatched. Every request is reviewed before an authorized service is scheduled, and we may decline a request for any lawful reason, including location, scope, safety or availability.

For an active emergency, calling 1-800-349-6549 is faster than the online form. If a situation is life-threatening, or involves gas, electrical hazards or structural collapse, call 911 or your utility company first.

Work is performed only within the scope you authorize. Where practicable, pricing or an estimate is provided before work begins; because conditions at a property can differ from what was described, an estimate may change once the affected areas are evaluated. Any change to the scope or price will be explained to you and requires your authorization before additional work proceeds.

Payment is due as stated on the estimate or invoice. Unless otherwise agreed in writing, you are responsible for the full cost of authorized services regardless of whether an insurer or another party reimburses you.

When you request service, you agree to:

• Provide accurate and complete information about yourself and the property, and update us if it changes.
• Confirm that you own the property or are authorized by the owner to request work on it.
• Provide safe access to the property and the affected areas at the scheduled time, and tell us about known hazards such as sewage, mold, asbestos, electrical faults or unstable structures.
• Secure or remove valuables, fragile items and personal belongings from the work area.
• Maintain your own property and liability insurance. We are not an insurer and do not guarantee that any service will be covered by your policy.

For applicable projects, job documentation may include photographs, service notes, moisture readings, equipment records, work descriptions and detailed invoices. This documentation is provided to help you and your insurer understand the conditions observed and the services performed. We do not act as your insurance adjuster or representative and make no representation about whether a claim will be approved.

Scheduled times are estimates and may change because of emergencies, weather, traffic or the duration of earlier jobs; we will let you know of material delays. If you need to cancel or reschedule, please contact us as early as possible. A fee may apply when a service professional has already been dispatched or has arrived and cannot perform the authorized work for reasons within your control.

By submitting a service request, you consent to Water and Drain USA LLC and the service professionals it coordinates contacting you about your request by phone call, text message (SMS) and email at the contact details you provide. Message and data rates may apply. Reply STOP to any text to opt out, or contact us to stop calls or emails. Consent to be contacted is not a condition of purchasing any service. You agree not to:

• Submit false, misleading or abusive requests, or requests on behalf of someone without their permission.
• Use automated tools to submit forms, scrape content or interfere with the operation or security of the Site.
• Copy, reproduce or distribute the content, logos or images on the Site without our written permission.

The Site and its content, including text, graphics, logos and images, are owned by Water and Drain USA LLC or its licensors and are protected by copyright and trademark law.

The Site and its content are provided "as is" and for general information only. Descriptions of services, timing and outcomes are not guarantees. To the fullest extent permitted by law, we disclaim all warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose and non-infringement. Services performed under an authorized scope are subject to the terms of the applicable estimate or invoice.

To the fullest extent permitted by law, Water and Drain USA LLC, its members, managers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of use, revenue, profits or data, arising out of or related to the Site or any service, even if advised of the possibility of such damages. Our total liability for any claim arising out of or relating to a service will not exceed the amount you paid us for that specific service.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Water and Drain USA LLC and its members, managers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys' fees, arising out of your breach of these Terms, your misuse of the Site, inaccurate information you provide, or your lack of authority to request work on a property.

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Before starting any legal proceeding, you agree to contact us and give us a reasonable opportunity to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time; the effective date at the top shows when they were last revised, and continued use of the Site or our services after a change means you accept the revised Terms. If any part of these Terms is found unenforceable, the rest remains in effect. These Terms, together with our Privacy Policy and any estimate or invoice you accept, are the entire agreement between you and us regarding the Site and the services.
